Impartial hearings
What Is an Impartial Hearing Order?
If you believe your child isn’t receiving the special education services they need, you have the right to challenge the NYC Department of Education’s decisions through an impartial hearing.
Many cases are resolved through a settlement, while others result in a decision from an impartial hearing officer.
These decisions or agreements may require the DOE to fund additional services, including ABA therapy, special education services, speech therapy, occupational therapy, counseling, evaluations, parent training, and other related services.
In some cases, a pendency (or “stay-put”) order allows your child to continue receiving certain previously established services while the dispute is being resolved.
