The basics

What is an impartial hearing order?

Under federal special education law, a parent who believes their child’s IEP does not provide an appropriate programme can file a due process complaint against the NYC Department of Education, now known as NYC Public Schools.
The case is heard by an impartial hearing officer. Many cases end in a settlement before a hearing. Others end in a written decision. In both situations the outcome can require the DOE to fund private services, including ABA therapy, evaluations and parent training.
Separately, a pendency or “stay put” order requires the DOE to keep funding your child’s current services while the dispute is being decided.
In plain terms
An impartial hearing order is a document that says the DOE has to pay for your child’s services. It names what is covered, how many hours, and for how long.
Your job is to choose a provider. Our job is to deliver the services in that order and handle the billing with the DOE so nothing comes out of your pocket.

From order to first session

We review the scope

Our clinical team confirms the awarded hours and services, and tells you honestly what we can staff and when.
STEP 03

Assessment and matching

A BCBA completes an assessment and we match your child with a technician who fits their needs and your schedule.
STEP 04

Services begin

Therapy starts, progress is tracked, and we invoice the DOE directly. You are not billed.

Eligibility

Who may qualify

  • NYC public school students with an autism or related diagnosis
  • Students whose IEP does not include ABA, or includes too few hours
  • Families with a pendency order in place
  • Students awarded evaluations or services through a settlement

Questions

DOE-funded ABA, answered

No. When services are covered by an impartial hearing order or settlement, the DOE is billed directly. There is no copay, deductible or out-of-pocket cost to you.

Many families go through the process without one, and some organisations help at no charge. We cannot give legal advice, but we can explain what documentation providers usually need and point you to resources.

The order sets the hours. We deliver what is awarded, and if the award does not match what your child clinically needs, we will tell you plainly.

Contact us as soon as possible. Remaining hours often need to be used before an end date, and we will tell you straight away whether we can staff the case in time.

The signed order, settlement or pendency decision, your child’s current IEP, and any recent evaluations. If you are unsure, send what you have.
